Fake license technology and the Identity Fraud Law

Night club bouncers will tell you that the technology to produce fake IDs is getting better all the time. In fact, it is good enough to fool the latest scanning devices.

All an underage individual has to do in order to buy alcohol, or to gain admittance to a popular bar in the state of Maryland is to purchase fake identification online. If caught, however, the young lawbreaker will face charges of either a misdemeanor or felony under the 2013 Identity Fraud Law.

Teenagers are more likely to have a fake ID

While people of any age can purchase false identification, for many different reasons, police confiscate most fake driver’s licenses from teens. Many of the licenses are of such high quality that they look just like the type issued by the motor vehicle department. The authorities believe the producers of these licenses are from China. There is meticulous attention in the details, right down to the fine print and watermarks. The U.S. customer makes the purchase with a credit card or sends cash overseas, and subsequently receives the fake ID card in the mail.

The applicable law in Maryland

The Identity Fraud Law, which is Section 8-301 of the Criminal Law Article, speaks to the use of fraudulent “personal identifying information,” such as name, date of birth, social security number and driver’s license number. As of October 1, 2013, the definition expanded to include fingerprints and health information as well as medical records. If classed as a misdemeanor, the maximum penalty is imprisonment for 18 months and/or a fine of $500. A felony, however, could draw a prison term from 10 to 25 years and a fine anywhere from $10,000 up to $25,000.

Other concerns

Underage students who are using phony IDs to purchase alcohol or to get into a night club is one thing. However, the expert manufacturing of false identification has given rise to concerns about homeland security. For example, the technology behind the fake IDs produced today is so good that the holders could use this kind of identification to get on an airplane. One can only hope that young people who purchase and use fake IDs for night club access will not elevate what is probably a misdemeanor, at the very most, to more worrisome extremes.
