Lochearn caregiver found guilty in elderly assault case

A 54-year-old Lochearn man who was facing second-degree assault charges has been found guilty by a jury after a two-day trial. The charges stemmed from an incident back in Dec. 2012 in which the man, who worked as a Baltimore County caregiver, was observed allegedly striking his 63-year-old charge on the arms and head while they were at a medical facility in Owings Mills. The man faces up to 10 years in prison and has been ordered to pay a fine of $2,500.

According to court records, the man transported the individual to the medical center to receive care. While he was with his charge in the waiting room, the man allegedly began speaking in an abusive manner to the victim and treating the person (whose identity and gender were not reported) his care in what was described by witnesses as a rough manner.

Although a subsequent examination of the individual revealed no signs of injury, workers who were employed at the medical office placed a formal complaint with the non-profit day service that employed the defendant. This prompted an investigation by the Baltimore County police and the Medicaid Fraud Control Unit, which is part of the attorney general's office.

Criminal charges like assault should not be taken lightly. Alleged assaults involving elderly victims may be viewed as particularly egregious by juries and judges. If convicted, a defendant could face a prison sentence and an expensive fine. An experienced Maryland criminal attorney can work with a defendant to build a criminal defense and help ensure that his or her legal rights are protected.
