A 39-year-old man already facing charges for exposing himself in the lingerie section of a Wal-Mart back in November pleaded guilty on another charge last week for allegedly having sexual contact with an underage girl back in March of 2013.
The 13-year-old girl who had been reported as missing earlier on the same day as the incident told Maryland State Police she met the man after leaving the Westview Promenade to go to downtown Frederick with the intention of purchasing drugs. There, she met the man who allegedly took her to his apartment after offering her marijuana.
According to court documents, the girl stated that during her time away from her guardians, she had sexual activity with two different men. Police were later able to track down the man after the girl gave a description in which she described a tattoo on one of his arms. The tattoo was of an image of him behind bars and had the tattooed words, “Never Again.”
Although the 39-year-old man has pleaded guilty, he maintains that the girl lied to him about her age. His attorney stated that the girl had informed him that she was actually 20 and that the sexual activity between the two was consensual. The man also has a previous criminal history but during the sentencing this past activity was not brought up.
The man was sentenced to 18 months along with an additional 8 1/2 year suspended sentence. He also faces four years of probation and must register as a sex offender for the remainder of his life.
