Maryland man faces charges related to underage pornography

A 35-year-old man was arrested recently on charges of possession of child pornography with attempt to distribute. A judge had ordered him to be detained until his next court appearance, but the man's criminal defense lawyer filed a motion to request he be released from custody so that he may live with his parents in Maryland. The lawyer said he is prepared to cooperate with mental health professionals to receive a mental health evaluation. His lawyer noted that he will also have to agree to relinquish his passport and stay away from underage children.

Police broke into the man's home with a ram. Once inside, officers say they saw him place something on a ledge outside a window, which they later discovered was a hard drive containing explicitly sexual videos involving minors. His lawyers have refused to comment on any of the allegations. However, in a motion they suggested that the accusation of attempting to distribute child pornography is unclear.

The lawyers working on his case said that he has a good employment record with a history of increasing responsibility. They further report that his lack of drug or alcohol abuse lends credence to the fact that he is a decent and loyal employee, family member and friend. However, the allegations include making purchases from a movie production company that features young, naked boys in their films. They also note that investigators identified the man's home IP address on a peer-to-peer network offering files that are consistent with child pornography.

A criminal defense lawyer may be able to lessen the severity of charges in a case involving child pornography if certain criteria are met. In some cases, that lawyer may suggest that a client undergo rehabilitation following a mental health evaluation, which may result in a reduction in jail time for the client.
