Maryland man faces 10 years in jail for selling ammunition to felon

U.S. District Judge Roger W. Titus sentenced a 43-year-old Maryland man to a decade in prison recently for selling ammunition to a felon. The defendant was also a felon.

The plea agreement states that the defendant bought 50 rounds of 9 mm ammunition from a dealer and then sold that ammunition to another buyer. When doing so, the defendant had knowledge that the buyer was a convicted felon.

Maryland state troopers and ATF agents searched the defendant's home months after the original ammunition purchase and found 196 rounds of ammunition, two semi-automatic handguns and two revolvers.

Under federal law, certain classes of people are prohibited from possessing firearms or ammunitions. These classes include:

  • Felons
  • Drug users and addicts
  • Fugitives
  • Individuals dishonorably discharged from the military
  • Undocumented immigrants and individuals in the U.S. with nonimmigrant visas
  • Individuals subject to restraining orders or who have been convicted of domestic assault

Illegally possessing a firearm can land someone in prison for up to 10 years, but so can knowingly selling or giving a firearm or ammunition to a person who is prohibited from possessing it. In this case, the defendant not only possessed firearms illegally but also sold ammunition to another prohibited person. The press release from the Department of Justice only mentions that he was sentenced for the second offense, but he may also face charges for possessing the firearms and ammunition.
